I really don't want to rain on your parade, but it is essentially a photo of somebody else's vision. It is a 3D sculpture and I'm sure the sculptor was aware of exactly where it was going and how it's composition, tone and texture would react with the surroundings.
I'm glad you liked his work though.
It is the nature of photography that everything we capture in our images was made by someone else - or by god (unless we made it ourselves of course ). Photography is simply a means of sharing how we see it - our vision. I could say exactly the same thing about your photos of guitars (unless you made those of course ). If you think the photo sucks, by all means you're welcome to that opinion. However, if you plan on telling me how or what I should take a pictures of, then you can stuff it.
I have no objection to your taking any photograph but as you gave the sculptor no credit and did not even name the work I probably wrongly assumed that you were saying, "this is my stunning image," rather than, "this is a stunning sculpture."

Interesting discussion. There is another role of photography: reporting. I think any photography is always doing that as it is a visual description of things in existence. As this piece is on very public display it look is in public domain. Maybe that will not make money to the sculptor, he/she should be proud, that people photograph this art. It means, that it has an impact.
