The rules big Mike mentioned also apply to Australia. If a work is commissioned then the commissioner owns the rights unless otherwise stated in the contract. In our case though it is entrenched in contract law, which amongst other things requires a form of compensation to remain binding.

So a lady commissions me to do portraits of her for free, no need for a contract, I own the rights. If she pays me then she owns the rights unless she signs them over to me in a contract.

Other than that case the photographer always has copyright.
