If someone has his pictures up on myspace or facebook or even a personal website for that matter. Another person creates a website and uses these "stolen" pictures obtained from other peopels sights without any permision at all is this legal?

If it is not legal, what can someone do to see that they have to remove all stolen pictures?

I don't know about myspace but facebook any images uploaded to them give Facebook a Royalty free right to use those images for any use they want (that means whilst the images are on their website they can use them for any gain and you are not eligable for any money).
Similar is also true of photobucket as well.

Places like Flickr will protect your rights however you have to do the legwork.
For starters if you contact the hosting company for a website with regard to content being stolen you can often have the website removed form their servers - this however does not stop the theif from moving to another website host company. You can also contact the owner of the site (First move really) with regard to charging or removal of images - its going to depend on the the site and the use of the image and yourself as to how far you take things but you can sue for costs - though chances are that the cost of sueing might be far more than the costs you get back (remember the other person could be living in another country).

Best thing is to talk to a lawyer if you get such a situation and see what they advise you is the best course of action
 
No, it's not legal, as for what you can do about it, it depends on how much time & effort you want to put into it. If you can demonstrate proof of ownership most reputable websites will remove the images.
