Waiting for Fries

I took these 2 of my nephew as we waited for his "fEYEs" at McDonalds. I like the 1st just because it says exactly how he was, bored and impatient for his food.. But I really wanted the critique on the 2nd one.. Is there anything I could have done in photoshop to make it better? do you think it should be tighter cropped? I can't decide if I like it or not.

I'd tighter crop the second one down to portrait. His ear is blown as well... and the light "break" across his head is distracting.

I'd try "flash fill" in paint shop - I think the equivalent in photoshop is equalise but not sure. Apart from that, its a great shot. The positive side is he is as cute as all get out... and his little face is nicely highlighted (if you know what I mean)

I've no idea how to improve the second one now, but the first one is wonderful!!
