Copyright blah blah blah...

I emailed the club and found out that it is just a random draw of members on their Facebook page. So she didn't enter it, she just had it as her profile picture with my watermark on it and they cropped it. Also there are NO rules or regulations for the contest.

Does this matter though? She didn't enter it and there are no rules to the contest.
Do you have the photo on a personal or business facebook page? If so, look closely at Facebook's TOS and the rights you (and everyone else) give Facebook to any of your images you put there. http://www.facebook.com/terms.php?ref=pf

Second, if the photo is not on any facebook account you have, and the club is using the image to promote themselves, you're going to need to read up on the OCILLA statutes (Online Copyright Infringement Liability Limitation Act): Online Copyright Infringement Liability Limitation Act - Wikipedia, the free encyclopedia

There are few people in the US that actually read EULA's, and TOS's.

I always thought EULA was some girl from Hawaii who wrote that fine print that I never read.

Protecting Other People's Rights

We respect other people's rights, and expect you to do the same.
  1. You will not post content or take any action on Facebook that infringes or violates someone else's rights or otherwise violates the law.
  2. We can remove any content or information you post on Facebook if we believe that it violates this Statement.
  3. We will provide you with tools to help you protect your intellectual property rights. To learn more, visit our How to Report Claims of Intellectual Property Infringement page.
  4. If we remove your content for infringing someone else's copyright, and you believe we removed it by mistake, we will provide you with an opportunity to appeal.
  5. If you repeatedly infringe other people's intellectual property rights, we will disable your account when appropriate.
  6. You will not use our copyrights or trademarks (including Facebook, the Facebook and F Logos, FB, Face, Poke, Wall and 32665), or any confusingly similar marks, without our written permission.
  7. If you collect information from users, you will: obtain their consent, make it clear you (and not Facebook) are the one collecting their information, and post a privacy policy explaining what information you collect and how you will use it.
  8. You will not post anyone's identification documents or sensitive financial information on Facebook.
  9. You will not tag users or send email invitations to non-users without their consent.

Also

Sharing Your Content and Information

You own all of the content and information you post on Facebook, and you can control how it is shared through your privacy and application settings. In addition:
  1. For content that is covered by intellectual property rights, like photos and videos (IP content), you specifically give us the following permission, subject to your privacy and application settings: you grant us a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use any IP content that you post on or in connection with Facebook (IP License). This IP License ends when you delete your IP content or your account unless your content has been shared with others, and they have not deleted it.
  2. When you delete IP content, it is deleted in a manner similar to emptying the recycle bin on a computer. However, you understand that removed content may persist in backup copies for a reasonable period of time (but will not be available to others).
  3. When you use an application, your content and information is shared with the application. We require applications to respect your privacy, and your agreement with that application will control how the application can use, store, and transfer that content and information. (To learn more about Platform, read our Privacy Policy and Platform Page.)
  4. When you publish content or information using the Public setting, it means that you are allowing everyone, including people off of Facebook, to access and use that information, and to associate it with you (i.e., your name and profile picture).
  5. We always appreciate your feedback or other suggestions about Facebook, but you understand that we may use them without any obligation to compensate you for them (just as you have no obligation to offer them).

In short, if this was retrieved without permission and you were not given credit, they are in violation of facebook's TOS/EULA. I would begin with contacting the club.

17 USC has been unconstitutional since 1790 and is still unconstitutional today.
Google Inc has faced me in US Courts now for three years regarding image search.
Neeley v NameMedia Inc, et al,(5:09-cv-05151)(11-2558)
Visual Art copy+rights were already ruled not to apply to the Internet!
Appeal is pending ...
I am losing against Google Inc thus far ...
I argued that EULAs and TOS are nothing nore than ignored coersions and should not be treated as legally binding when no digital authentication of signature is done.

Enough of this crap already. We get it. You have an agenda. Take it somewhere else.

After reading this I became curious enough to check his history. Curtis - your 11 posts of the same thing is known as spam. Please stop.

It was not nice but there is nothing you can do regardless. Blah.....Blah.....Blah.....Blah.....Blah.....Blah.....Blah.....
It does not matter about copy-right whatsoever. Blah.....Blah.....Blah.....Blah.....
It was not nice and you should let them know that you are bothered. It is not an artistic photo and having your name on it would be pointless. Removing a watermark is an insult but may not have been meant as one. You should find out.
Blah.....Blah.....Blah.....Blah.....

You again? More blah blah blah!

If it used to be Curtis.Neeley and had like 8 posts. Does TPF management know you have joined again as Curtis_Neeley and have 4 posts?

Big Brother is always watching - always aware ;)

I am not aware of whether they know I joined again but I was "banned" for no apparent reason. I do not spam and see from over 16K posts you are very active. If "they" ban me again, as is their right, I will ban TFP from my computer and all users of my connectivity or my IP, as is my right. I doubt many users from this apt complex visit TFP and it will amount to nothing.

Yourself included.

Otherwise, you'd quit posting over and over and over about the same issue you seem to think we give a damn about.

If you have something of value to contribute, we're all ears.

If not,
