beautiful bird. and that's better than any of the shots I've taken of Kestrels.
Love the pose and the framing of the branches.
looks like you have a spot of dust on the sensor but that should clone out very easily in PS.
Might be worth playing with the curves in PS as it might give the shot a bit more punch

you have some chromatic abberation on the tree, i guess this is cropped from an image which originally had the kestrel in the centre or centre bottom?

The CA could be healed with software

As for the second edit, the kestrel looks better, but you lost the sky a bit I think.

Your right. The kestrel looks better in the bright version but both the sky in the the branches look better in the darker version IMO.
In your version it seems a little to sharpened maybe?

I guess it needs some more work.

I just had a quick go at it ... and I tried to selectively enhance the background, but my mask was too tight so it left some white border in the end, that gives the halos you see (so they are not from sharpening.. I did sharpen though).

Tried to remove the CA, but with only little sucess.

And stamped out two dust bunnies on your sensor
