Bird attempt 2 (Not sure what it is??)

Was heading out to meet up with some friends and saw this little guy sitting in the tree one yard over from my apartment building. The first shot doesn't have the best focus but I like it - I think it was yawning or something because it didn't make a noise.

Very cool even without focus its nice to see like that in the first one. It looks like it could be a fledgling, waiting for its mum to bring it some food, there is also a parasetic worm that causes "yauning" disease where they hold there mouth open like that even after they are no longer being fed by their parents, but they dont usually last very long so unusual to find them like that, either way its a rare shot.

Ah well let's hope he was just tired and doesn't having paresetic worms then. Still don't know what sort of bird it is and I have left my field guide out at my parents place.
