Neither, as neither one owns copyright to it. Also, neither one is a god or ghost. LOL

The U.S. Copyright Office has settled the recent debate over the so-called monkey selfie, declaring in updated rules that a piece of content produced by an animal can't be registered.

Neither can content created by ghosts and gods. Seriously.

I would never "take advantage" of the guy. I don't feel I'm doing that by using it as an very small avatar on a community forum. Now, if he was to contact me personally and ask me not to use it, I would oblige.
