Those cases are examples are where the photo was used for its original purpose, as an illustration, and not where the photo itself was the object of any education, criticism or editorial efforts.

That is a significant point of Fair Use, to allow and encourage the discussion of copyrighted works.

Also; taking a photo of a photo is not copyright infringement.

Some people make millions doing just that.
