I like these a lot, and think the first one is quite superior.
The second one is a photograph of a seagull, albeit quite a nice one. The dark background is a nice departure from what we normally see with wildlife photography.
The first one is evocative, potentially, of a whole lot more. Sure, they're out of focus birds, but they give a ghostlike or ephemeral sense, and they echo the in-focus birds lower down. The b&w with the dark background is visually dramatic, as is the rim-lighting on the birds. The dark and murky background (probably just some trees and crap, but it COULD be a "deep dark forest" or almost anything, it could be magical, it could be evil, it could be so much more than a bunch of trees). You are free to imagine that they're ghost birds, or some symbol of freedom, or peace, or whatever floats your boat.
The point is not a specific set of symbolic mumbo-jumbo, the point is that the picture is open-ended and invites us to imagine and feel a lot more than just "picture of a seagull".
