I think you would pass. She is not the unfit-test but her habits are just dirty. I guess I didn't mention this but two weeks ago she left her used tampon on the bathroom counter. not cool. Well, atleast I am not the one that has to share the bathroom with her.

You have no lease with her and she is not on the lease. She has minimal rights. She does have SOME, but not alot and it would cost her too much money to fight it. You need to put it in writing that you would like her out on x date. Be civil and respectful and things will be fine. I hope.

This is not correct. If she has paid any rent to the OP, she is a lessee. California has no lease rental rights. Which basically will afford the renter all the standard protections of California landlord tenant law if any money for rent has changed hands, regardless of any formally drafted lease contract. What is worse is that if the OP never specified an end point to the lease, it could be viewed as a tenant option month to month lease. And rent control could even possibly apply. Meaning that if the OP EVER wanted to kick her out or raise the rent, he'd have to file an eviction notice and go through formal eviction processes. Which given what he has stated would be unlikely to win. It's possible, depending on very specific facts, that it may not be quite as serious as that, possibly the OP could argue for an assumed 1 year lease period, meaning that the original tenant would have a year's rights to live there, and then, after that must be given 90 days notice if the OP wants her out (she only has to give 30 days notice of her intent to move in such a case).

I know NC law gives tenants 5 days past the first to pay rent. Renters are obligated to provide this grace period. Instead of asking a forum, I'd recommend telling her that if she can't live up to your standards of cleanliness, you will have to ask her to move out. Chances are she will be more tidy or start looking for a new place to live rather than put up with the hassle of court, etc.

Or she could withhold rent until he 'fixes' it and essentially live there for free.

yes, being as nice as possible, but indicating you'd like for her to move out, is probably your best path. Since it is very likely that landlord tenant law in california would come down on her side if she got angry and decided to push the issue.
