I'm really confused as to why the legs on the first seagull have a shadow behind them.

The gull was hovering in place. I believe its motion blur, like the wings have from slow shutter speed

It is motion blur captured after the flash fired freezing the gull.

My guess for the first image you used first curtain synch, so shutter opened flash fired, shutter remained open to complete the exposure, ambient light comes into play and you get motion blur.

Rear curtain synch would have left shadows trailing the gull, not in front as indicated by the legs of the gull.

I could be wrong though, it could be either first or 2nd(rear) curtain, as you say the gull was hovering and it could have been moving backwards slightly.
 
first one looks like it's sitting in front of a picture. The waves seem like they should be more sharp given a quick exposure? Looks fake to me. I'm sure it's not, but that would be my first guess. The shadow looks to even.

Not fake. d300 f4.5 1/60 iso 400 with pop up flash. waves in the background are at least 300 yards away
