should i report this to ebay. seller did say in description that it was a european model

You can't go after the seller for this now. If he stated in the auction it was the European model then you were informed before buying it. Unfortunatly you're stuck with a camera and no warranty. Luckily they are pretty solid cameras with few faults (I have a D90 as well). The likelihood of you needing warranty service is pretty slim, but if it does happen then you are out of pocket for the costs of such repairs. There is no difference between the EU model and the NA model other than a serial number. Enjoy the camera! Hopefully you didn't pay the same amount for it as a retail camera bought in the US.

i saw that i put seller did state that it was a euperon body...that was a typo

If he didn't state it was an eu model, send it back. If he refuses put in a dispute with eBay over it. They will force him to take it back and issue a refund.
