Lens aperture isn't the only thing that affects DoF. Fous point distance, lens focal length, focus point to background distance, all play a part in determining what parts of a scene are in focus.

Focus is sharpest in a plane paralellel to the camera at the point of focus, and starts falling off in front of and behind that point of focus.
