First (2) Booooddddwaaahhhh Shoots tomorrow, advice?

While I completely understand your client's wish not to have their images publicized, it's important for you as the photographer to make sure that they are aware that you're doing it simply as a courtesy, and NOT because you are in any way obligated to (unless you have given up the rights to these images). Most people do not understand their rights and obligations when it comes to their images.

so would this mean that when I have a client fill out a minor model release for their child and they say that I can't use the images either in my protfolio or on my website, that means that I really can if I want to?

It's not your fault if the client doesn't understand what they're signing, but I think you better make sure that they do...
You may or may not be legally required to, but ethically, I think you should.

Once I edit them I will ask if there are one or two of them that are not indecent that I can share. :)

I also "booked" two more for may. Woo hoo!

Well, edit a few of them into "body shots" (from the neck-down) so they will be anonymous, present them, and ask if you can post them since they won't be recognizable....
 
Guys, I know you're all getting horny hoping to see some boudoir shots, but, unlike a model who is posing for some magazine, these sound like they were for a couple to enjoy privately. I've seen many ads to have some boudoir shots done for your spouse and such and pretty much all of them specify that the pics will never be shown to anyone else. If the clients thought the contract allowed the photographer to post online, they would lose most of those types of sales I would guess.
 
you should learn more about the people on this forum before you post something like that...

Just so you know, most of the people who have posted that they would like to see the images are regulars here and are more interested in seeing the images either in an artistic sense or to give the OP some constructive criticism in order to help her on her next sessions like these.
 
I certainly didn't mean to offend anyone. Perhaps the term "horny for" was not the best in this case. It was meant as the expression meaning eager, anticipating etc... not the perhaps more darker one of the adult nature. However in this case I should have used another term.

And as far as getting to know people from the forum, I'm sure many are very professional and don't have a care about what the subject is in the photos. But if you give a look at any post with the word glamour or boudoir for some rather bizare unexplainable reason they all have very high post counts. We're all human. Certain subjects will pique our curosity more than others.
 
Oh I TOTALLY want critique, but as I said I informed both parties that these would be for their eyes only. After I edit some and all of that, I might see if they'll let me post them for my learning. If they're not comfortable with it, I've already started critiquing them myself. :lmao: "Why the hell didn't I see that while I was there?!"

When I find out whether they agree to it or not I will. In my opinion they're ok. Lookin back there's some thing I wish I had done better and I wish the 19 yr old would have had a lil more personality but yeah, they're ok.

I wouldn't push the issue. Keep their wishes.

I agree with Tirediron though, you own the rights to do with the images as you wish, its your policy to keep the clients privacy. Try not to sign that away.
I'm always reminded of the photographers who released Madonna's nude shots (taken when she was 18) and published in Playboy and Penthouse when she was rising to the height of her popularity in the 80's. You never know.

If they asked to not post, don't post and don't continue asking them for their permission. If you wanted to post the shots beforehand, you should have asked or got permission before.

I think since you don't know anyone on this forum you should really quit this train of thought now. It's borderline offensive for a new member to come in and accuse people of being compulsive animals. Maybe the reason the people with higher post counts come in here is because they go into a *lot* of threads and post helpful replies, no? As opposed to your non-helpful reply which insinuates everyone on this board has the self-control of a pre-pubescent teen. Also, the word "horny" has but one definition...and it deals only with arousal.



As for the OP: as others have said the rights are *yours* when it comes to what you can do with the pictures, but as you already know that doesn't mean do what you want. It's usually much better to abide by the subjects' wishes because it will make things go more smoothly in the future. If word starts getting around that you do whatever you want without caring what the subject wants it'll essentially be the end of your career. On top of that, it's just somewhat rude. I wouldn't push them too hard on the subject...it's not really too big of a deal. In the end, there are many people here that would be helpful in the C&C...but there will always be other opportunities (you already said you have another shoot planned. Congratz!) and as long as you and the recipients are happy with the shoot...that's all that matters.

That's a fine point of law which would would depend on where in the world you are; a great many items in contracts and agreements are unenforceable, however if it's something to which you have both agreed, than IMO, it would be grossly unprofessional to violate that agreement, even if you do have the legal right to do so.

I should have been more clear in my first post. I made the assumption that the OP was making the same mistake that so many people doing their first "real" work do and that is to not have a contract. If that is the case than the only restrictions in effect are the IP laws that apply in her area, and, were that the case, the client would have no recourse should the OP decide to publish the images. Would it be unethical? I would say so.

My point was simply that without a valid, enforceable contract to the contrary, the subject of an image doesn't usually have as much say over what happens to that image as they think they do, and it's important that they understand what the law says.
 
Technically, this isn't real work, but even with my lil friends and such I'm getting release forms and such, just to cover my ba-tooty. Especially with this girl being only 19. I kind of felt like I was doing a barely legal shoot. :lmao:

I won't even bother with asking her because I wouldn't feel good about posting pictures of someone so young, but the other lady is a good friend of mine and she knows that I often ask for advice here and after she views her photos I might ask if there are any she would be willing to share. This is it. There's really nothing else to say.... I know most of you just want to see the results of the shoot, and some of you wanna see some skin, but it doesn't really matter. I'm going to stick by what I originally said. THank you all for the advice and words of wisdom. :hug::
