I am so excited! I did maternity pictures for a friend of mine, and a friend of hers saw them and asked for a referral! So now I have 3 maternity shoots in the next month :D

Any tips would be greatly appreciated!!

Get a contract written up that includes a model release.

Charge money.

Contract is a good idea - does anyone have a template I could look at?

I don't feel comfortable charging yet, I just started my photography class. One of the girls lives quite a ways from me and doesn't drive (we live in Japan), so I am going to her place - so I am charging her for travel only. I just don't feel like I'm on the level to charge yet.

Thanks everyone :)

I get bogged down in google, especially with the 15 month old running around LOL.

Thanks for the links :)

Whoa.....that contract sucks....and model relase law varies by state.

Here are some changes and other notes:

  • Get rid of the min / max # of photos stuff. Don’t make any count promises, because of out-takes.
  • The word deposit isn’t a good word to use. Check with the laws of the state you reside in, this may not be enforceable where you live. At the least change the wording from ‘deposit’ to ‘retainer’, there is a huge legal difference.
  • Giving the client images on a CD - before they order - is not advisable.
  • Jeez, who wrote this crap? Do not use any of their #5.
Use the following instead:
5. Print Reproduction and Use License Agreement

This Print Reproduction and Use License shall be governed by the laws of the county of ___________ in the State of _________ and any applicable federal or international law.

All of these images are protected by United States Federal Copyright Law, © 2010 (Copyright Owners Name), and provisions of the international Berne Convention, all rights reserved.

This license grants (your client name here) and their immediate family the right to print, or have printed, any of these images. No other usage rights are granted or implied.

Reproductions of the images are for personal, home, and work place use only, and may not be entered in any contest, used for any commercial purpose, sold for any reason, nor be placed anywhere on the Internet without the written permission of, (Your Studio Name).

Please remember that because these images are protected by Federal Copyright laws they may not be altered, copied, transmitted, or used in any way without prior written consent of the copyright owner, {name or studio here}.

Images appropriately formatted, sized, and marked for Internet use have been provided separately and are covered by a Reproduction and Use License Agreement specific to Internet use.

(Your Studio Name) is not responsible for the quality of any prints not purchased from, (Your Studio Name.)

Authorized Signature: (Copyright Owners Name) Date: _____________

Client Signature: ___________________________ Date: _____________
------------------------------------------------------------------------------------------------------------------------------------------
Additional notes:

In addition to a paper copy for the client (and one in your files), you should also put a PDF copy of the license on any disc the client buys, as an image or PDF file.

You can add whatever other restrictions or permission you desire. As an example you could limit the size they do prints, "the right to print, or have printed, any of the images on this disc at a size no larger than 10 inches by 15 inches.”

Or, you could allow Internet use of the images.

One last note: Don't call it a Copyright Release unless you are actually intending to be giving away ownership of the copyright. If you do, the image could legally be interpreted as no longer yours and you would then not be able to use it in any way, without the written permission of the new copyright owner.

I think I like the NYIP one, I just want her to sign a release saying that I can use the pictures for advertising etc. As far as charges etc, I'm not charging yet so I don't see the need for that part of a contract. She's only paying me for travel. Once I start charging I will revamp the contract to reflect that.

Being in Japan, the NYIP release may be worthless. Not only do release laws vary by state, the also vary by country.

Japanese copyright and contract law will differ also.

we're both military wives, from different states (which are technically still our legal residences).

I'll check with one of the photographers I know here and see what she does in this situation.

I have some tips for getting more referrals in a recent post. As far as maternity pictures (or any pictures for that matter) remember that is all about the light. Find great even, soft light first then worry about backgrounds and such later. Also, shoot pregnant women from above when possible.
