Legal question...

You should go to a law forum and ask about exposure settings for taking that picture. You'll probably get the answer you are looking for.
 
You are concerned that someone making 7-10/hr is going to care about you taking pictures in the building that could care less existed or not? I think you'd have to go to quite a few before someone said something about you taking a picture there. The odds that you see a franchisee owner or district manager are slim, live on the edge a little and take a picture in a fast food joint.
 
Ha love the ask exposure comment. My thoughts exactly shooter. I do appreciate the warnings and I understand what everyone is saying. I will heed them, and will settle for a creamy bokeh of a dd establishment loll

And there we have, ladies and gentlemen, what may well be the single, worst piece of "advice" ever offered on this forum.

You're absolutely right, the chances of the franchise holder, senior manager, etc, being present are slim to none. Will the minimum wage server behind the counter care? Probably not. Who will care? The corporation's legal department. Someone earlier alluded to the fact that Little Trees (The company that makes those tree-shaped air-fresheners) is not a company to mess with as far as trademark infringment goes. Very true. They have an internal contest called "Spot the little tree" where all employees are encouraged and rewarded for passing any sightings at all of the company's product to the legal department for potential C&D/civil action. THAT'S how serious companies are about protecting their IP; it would REALLY suck to get this great shot, and have it make a bunch of money, only to wind up in court over trade-mark infringement.

Took the shots outside of dunkin with the establishment in the background. It was a cool concept. The photo won't be used on the website to sell the item but solely an image for the social networking sites. Their product has nothing to do with coffee or doughnuts and uses only the colors of dd's logo. There shouldn't be any issues. Thanks for the feedback

Dunkin Donuts must be VERY different in the Midwest. Around here they are all owned by predominantly Indian families who not only own it, they are taking your order, making the coffee or running the drive through.
 
If you are looking for the color theme of the famous double Ds, why not use the almighty Google to look at images on the web?

Incase anyone is wondering, if something is 20% different then the original design then it isn't a Violation of a trademark. I had a discussion with the buyer of spencer gifts, which the company deals with this stuff regularly. I didnt have my mind made up, if you noticed I originally wanted to take the shot inside and settled for having the establishment in the background. Forums are humorous but I do appreciate the feedback

No doubt, and I can't begin to thank you enough for all the laughs you have provided since you joined.

Is that why you don't participate in anyone else's threads but your own? It seems we never hear from you unless you want something, and then you get argumentative when what you get isn't what you expected to hear.

Of course the 20% BS is utter non-sense, which is easily checked out, which obviously you didn't do after having a discussion with some buyer at Spencers. Trademarks Home
